TEMPO.CO, Jakarta - The International Criminal Court (ICC) on Wednesday condemned new U.S. sanctions against four of its officials, calling the action a direct assault on judicial independence and the global rules-based order.
"The International Criminal Court deplores the announcement of new designations for sanctions by the US administration against ICC Judges Kimberly Prost (Canada), Judge Nicolas Guillou (France), Deputy Prosecutor Nazhat Shameem Khan (Fiji) and Deputy Prosecutor Mame Mandiaye Niang (Senegal)," the ICC said in its statement.
A "Flagrant Attack" on Judicial Independence
The U.S. decision extends previous sanctions on ICC judges and prosecutors. According to the ICC, the sanctions are "a flagrant attack against the independence of an impartial judicial institution which operates under the mandate from 125 States Parties from all regions."
"They (the sanctions) constitute also an affront against the Court’s States Parties, the rules-based international order and, above all, millions of innocent victims across the world," the statement said.
The ICC affirmed that it will continue to fulfill its mandate "without being influenced by any form of restriction, pressure, or threat" and urged governments to provide firm and consistent support for the court.
The ICC affirmed that it will continue "fulfilling its mandate, undeterred, in strict accordance with its legal framework as adopted by the States Parties and without regard to any restriction, pressure or threat."
The international court also called on nations globally to support its mission. "The Court calls upon States Parties and all those who share the values of humanity and the rule of law to provide firm and consistent support to the Court and its work carried out in the sole interest of victims of international crimes."
Breakdown of the Sanctions
On Wednesday, the U.S. imposed the sanctions under Executive Order 14203, which targets "hostile ICC attempts" against the U.S. and Israel. The U.S. Department of the Treasury added the four officials to its Specially Designated Nationals (SDN) list, which subjects them to economic and trade sanctions.
According to the U.S. Department of State:
Judge Nicolas Yann Guillou was sanctioned for approving an arrest warrant for Israeli leader Benjamin Netanyahu and former Defense Minister Yoav Gallant. Guillou, a French legal expert who once worked with the U.S. Department of Justice, issued the warrant in November 2024. Netanyahu and Gallant were accused of war crimes and crimes against humanity in Gaza.
Judge Kimberly Prost, a Canadian, was penalized for endorsing the investigation of alleged crimes committed by U.S. personnel in Afghanistan.
Deputy Prosecutors Nazhat Shameem Khan (Fiji) and Mame Mandiaye Niang (Senegal) were sanctioned for "continuing to support illegitimate ICC actions against Israel," including enforcing the arrest warrants against Netanyahu and Gallant.
The sanctions come as Israel faces mounting international criticism for its military campaign in Gaza, which has killed more than 62,000 Palestinian civilians since October 2023. The war has devastated the territory and led to widespread famine. Israel is also facing a separate case of genocide in the International Court of Justice (ICJ) for its actions in Gaza.
