
TEMPO.CO, Jakarta - The Coordinating Minister for Legal, Human Rights, Immigration, and Corrections, Yusril Ihza Mahendra, spoke up about the death of Juliana Marins, a Brazilian tourist who died after falling into a ravine on Mount Rinjani. According to him, Indonesia cannot be sued over Juliana's death.
It was revealed recently that Juliana Marins' family and the Brazilian government plan to sue the Indonesian government at the Inter-American Commission on Human Rights. But Yusril said filing a lawsuit would be impossible as Indonesia is not a forum member.
"You can't bring a country into a forum if it's a non-party member of the convention," the minister said in a press conference on Friday, July 4, 2025.
Indonesia also cannot be sued directly in institutions such as the International Court of Justice (ICJ) or the International Criminal Court (ICC). "It can only be done upon the consent of the member country," said Yusril.
As an alternative solution, Yusril suggested the Brazilian government engage in a joint investigation with Indonesia. "The results will be disclosed if approved by the Brazilian government," said Yusril.
Previously, it was widely reported that the Brazilian government would hold Indonesia accountable for the death of Juliana Marins. The plan to sue the Indonesian government was revealed by The Federal Public Defender's Office of Brazil (FPDO), a human rights observatory in Brazil.
The FPDO plans to take legal action if further autopsy results of the late Juliana Marins show negligence leading to the 26-year-old woman's death. Meanwhile, the Indonesian government claimed that the autopsy results indicated Juliana's death was purely accidental.
Juliana died after falling while hiking Mount Rinjani on June 21. She was only successfully evacuated by rescuers four days later due to harsh weather and difficult terrain at the scene.
