Jakarta Drafts New Air Pollution Bylaw to Strengthen Law Enforcement

TEMPO.CO, Jakarta - The Jakarta provincial government is drafting a new regional regulation (perda) to replace Regional Regulation Number 2 of 2005 concerning Air Pollution Control. The Head of the Jakarta Environmental Agency, Asep Kuswanto, stated that this revision aims to strengthen supervision, law enforcement, and the protection of public rights in maintaining air quality.

"We want to ensure that the environmental supervision and law enforcement system in Jakarta operates more firmly, transparently, and in an integrated manner between the local government, law enforcement officials, and the community," Asep said in a written statement on Friday, October 24, 2025.

Asep mentioned that the draft regulation will establish a more effective law enforcement mechanism, including inter-agency coordination and the management of funds from fines for environmental recovery activities. The preparation of this regulation also aims to create fair air quality governance.

With the introduction of the new local regulation, it is hoped that the legal framework will become stronger, and consistent law enforcement will lead to improved air quality in Jakarta. In response to this plan, Andri Gunawan Wibisana, the Chair of the Indonesian Environmental Law Practitioners Association, emphasized the importance of responsive and smart regulation in law enforcement.

Administrative sanctions, such as government coercion, fines, or permit revocation, should be applied gradually and selectively, adjusting according to the level of risk and the impact of the violations. According to him, such an approach is effective in changing the behavior of businesses and the public to comply with environmental regulations. "If the violators do not comply with written warnings, the government can impose reparative or recovery government coercion," said Andri.

Environmental oversight practitioner Bambang Pramudyanto also agreed that cross-sector collaboration is key to the effectiveness of supervision and law enforcement. The role and responsibility of the Environmental Agency and its sub-district offices need to be strengthened, especially since the current surveillance burden is disproportionate to the number of environmental permits and approvals that have been issued.

Increasing budget allocation for operational oversight, case handling, and investigation is also crucial for the optimal implementation of environmental law enforcement. Bambang also suggested that the draft regulation clearly define the synchronization of criminal provisions, administrative sanctions, new legislation, pollution control cost mechanisms, ambient air quality standards, and emission standards for mobile and stationary sources. These standards should be included in the regional regulation.

"Furthermore, the Governor's authority to evaluate environmental oversight also needs to be clarified for the environmental governance in Jakarta to become more effective and accountable," added Bambang.
