
TEMPO.CO, Jakarta - Former soldier Satria Arta Kumbara lost his status as an Indonesian citizen. Minister of Law Supratman Andi Agtas stated that the loss of citizenship was not due to a revocation process by the state, but happened automatically due to violations of the Citizenship Law.
"However, if the person is proven to have become a foreign soldier, they automatically lose their citizenship status," Supratman said as quoted from Antara, Wednesday, 23rd July 2025.
In addition to becoming a soldier in another country, a person could lose their Indonesian citizenship status due to various factors. This is explicitly regulated in Law Number 12 of 2006 concerning the Republic of Indonesia's Citizenship.
These provisions are explained in Chapter IV, Article 23, which outlines the various circumstances that result in the revocation of Indonesian citizens' status. These conditions are as follows:
- Acquiring another citizenship of their own accord.
- Not refusing or not renouncing another citizenship, even though they had the opportunity to do so.
- They were declared to have lost their citizenship by the president upon their own request.
- This request can be made if the person is 18 years old or married, residing abroad, and the loss of Indonesian citizenship does not render them stateless.
- Joining the military service of a foreign country without prior permission from the president.
- Voluntarily joining the civil service of a foreign country, for positions in Indonesia that can only be held by Indonesian citizens, according to the laws and regulations.
- Voluntarily taking an oath or pledging allegiance to a foreign country or a part of the foreign country.
- Participating in the election of a foreign state, even if not required.
- Having a passport or document similar to a passport from another country that is still valid in their name.
- Residing outside the territory of Indonesia for a continuous five years without valid reasons and intentionally not declaring their intention to remain an Indonesian citizen before the end of the five years.
In addition, Article 26 regulates the loss of citizenship due to marriage, namely:
- Indonesian women who marry foreign men lose their citizenship if, according to the laws of the husband's home country, the wife's citizenship follows that of the husband.
- Indonesian men who marry foreign women lose their citizenship if, according to the laws of the wife's home country, the husband's citizenship follows that of the wife.
- However, they can maintain their Indonesian citizenship by submitting a statement to an Indonesian official or representative, unless doing so results in dual citizenship.
Lastly, according to Article 28, a person's citizenship may be declared invalid if it was obtained based on information that was later proven to be false or inaccurate.
