House to Draft Special Legislation on Wiretapping

TEMPO.CO, Jakarta - Chairperson of the House of Representatives Commission III, Habiburokhman, stated that parliament is planning to draft a special law dedicated to wiretapping.

He explained that the working committee for the revision of the Criminal Procedure Code (KUHAP) had agreed not to include wiretapping authority for law enforcement in the current draft.

According to Habiburokhman, who is a politician from the Gerindra Party, the House had already included this initiative in its legislative agenda since the previous term.

"In fact, we have already made several working visits, meaning that there has been state funds allocated to discuss wiretapping," said Habiburokhman, as quoted in an official statement on the House's website on Saturday, July 12, 2025.

The KUHAP revision had previously included provisions related to wiretapping. However, the Indonesian Advocates Association (Peradi) called for its removal from the draft bill. Peradi’s Vice Chairman, Sapriyanto Refa, raised concerns that wiretapping for investigative purposes could be misused.

"In this coercive effort for common crimes contained in the KUHAP, wiretapping must be eliminated," said Sapriyanto during a public hearing with Commission III of the House at the Parliament Complex in Senayan, Jakarta, on Tuesday, June 17, 2025.

He pointed out that wiretapping is already regulated under several other laws, including the Narcotics Law, the Corruption Law, and the Police Law. "Let that be within the realm of those respective laws, there's no need to incorporate it into the KUHAP," he said.

For this reason, he proposed that the coercive measures listed in the KUHAP bill should be limited to the determination of suspects, arrests, detentions, document examinations, searches, seizures, and/or travel bans for suspects located outside of Indonesia.
