New Trump Policy Could Allow Migrant Deportations to Third Countries with 6 Hours' Notice

TEMPO.COJakarta - The Donald Trump administration has introduced a new policy that could enable the deportation of migrants to countries other than their home country with as little as six hours' notice. These deportations could reportedly be carried out without security guarantees from the receiving nation.

According to a report by The Washington Post, citing an internal memo from acting director of U.S. Immigration and Customs Enforcement Todd Lyons, a recent Supreme Court ruling has opened the door for deporting immigrants to "alternative" countries without diplomatic assurances of protection from torture or ill-treatment.

In cases where deportation is to a country without such "diplomatic assurances," deportees would ideally receive 24 hours' notice. However, the report states that in "exigent" circumstances, deportations could be carried out in as little as six hours.

For those being flown to places offering such guarantees, deportations could proceed without any prior notice.

This new U.S. policy marks a significant shift in deportation practice. Previously, migrants were rarely sent to third countries.

Among those who may be affected are thousands of immigrants who could face danger in their home countries. The policy also impacts people from nations like China or Cuba, as these governments are not always willing to accept deportations due to strained diplomatic relations with the U.S.

Immigration lawyers have warned that this policy could endanger thousands of long-term immigrants who have work permits and family in the U.S. They could be expelled and sent to places where they have no family ties or even a common language.

"It puts thousands of lives at risk of persecution and torture," said Trina Realmuto, Executive Director of the National Immigration Litigation Alliance, which challenged the recent Supreme Court ruling.

Simon Sandoval-Moshenberg, lead counsel in another immigration case, stated that the move will definitely affect thousands of people. He added, "This is a category of people who understood themselves to be out of the woods."

Realmuto's organization sued the Trump administration in March, alleging that the practice of sending migrants to countries where they could be at risk violates federal law. The lawsuit includes the case of a Guatemalan man who was deported to Mexico and subsequently kidnapped and raped.

Separately, U.S. District Judge Brian Murphy temporarily barred the Trump administration from sending immigrants to third countries without at least 10 days' written notice, intending the period to provide a "meaningful" opportunity to challenge the deportation.
