TEMPO.CO, Jakarta - Coordinating Minister for Legal, Human Rights, Immigration, and Correction Yusril Ihza Mahendra said that transferring the case involving former Deputy Attorney General for Special Crimes Febrie Adriansyah to the Office of the Attorney General could expedite the legal process.
"There's some truth to what the Attorney General's Office said. From a procedural legal standpoint, the case can be resolved more quickly if the Attorney General's Office conducts the investigation," Yusril said when confirmed in Jakarta on Monday, as quoted by ANTARA.
Yusril explained that in corruption cases, the National Police (Polri) has the authority to conduct investigations and inquiries, while prosecution falls under the authority of the Prosecutor's Office. If the police are conducting the investigation, the case file can be submitted back and forth until the prosecutor deems it complete.
Yusril believes the process would be more efficient if the Prosecutor's Office were responsible for both investigations and prosecutions, as both functions would then be under one institution. However, Yusril believes that the main challenges in this case are not only the speed with which matters are handled, but also maintaining the independence and objectivity of the legal process.
He said it was natural for the public to question the independence of the Attorney General's Office because the suspect was a former Deputy Attorney General for Special Crimes.
"The public will, of course, ask whether this could be 'jeruk makan jeruk' (one of their own) because the investigator and public prosecutor who handled the case were once subordinates of the suspect," he said.
Therefore, Yusril asked that public doubts be answered through a firm, professional, and transparent legal process. He believes the Attorney General's Office will maintain the institution's integrity and ensure that investigators and public prosecutors work carefully, objectively, and in accordance with legal provisions.
According to Yusril, handling this case is an important test for the Attorney General's Office in maintaining its dignity, honor, and authority as a law enforcement institution.
He added that the Indonesian legal system has provided oversight mechanisms, including through the supervisory authority of the Corruption Eradication Commission (KPK) and public oversight of the legal process.
He said the government supports the involvement of the media, the House of Representatives (DPR), the public, anti-corruption activists, and academics in monitoring and criticizing the investigation and prosecution processes to ensure objective enforcement of the law.
"As a result, the law is truly enforced objectively, without being influenced by extralegal considerations," said Yusril.
Previously, former Deputy Attorney General for Special Crimes Febrie Adriansyah was named a suspect in an alleged corruption case involving coal management that triggered a power outage in Sumatra.
Meanwhile, Rudi Margono, the Deputy Attorney General for Supervision and Acting Deputy Attorney General for Special Crimes, emphasized that the Attorney General's Office will handle the case professionally, upholding the principle of the presumption of innocence.
"Synergy is needed to ensure that this case is handled truly professionally, upholding the principle of the presumption of innocence, so that there is certainty in its resolution," said Rudi at a press conference in Jakarta on Saturday, July 11.
