Airlangga: Indonesia-US Trade Deal Unaffected by US Court Ruling

TEMPO.COJakarta - Indonesia's Coordinating Minister for Economic Affairs Airlangga Hartarto stated that the Indonesia-United States Reciprocal Trade Agreement (ART) remains in progress, despite the recent ruling by the United States (US) Supreme Court invalidating the United States' global tariff policy.

"This is still ongoing because the agreement stipulates that it take effect within 60 days of signing, and that each party consult with the necessary institutions," Airlangga said, as quoted on the Presidential Secretariat's official YouTube channel on Sunday, February 22, 2026.

He explained that the United States Supreme Court ruling, among other things, requires the United States government to refund tariffs already collected from each corporation. However, according to Airlangga, the Reciprocal Trade Agreement signed by the two countries has its own mechanism and is not automatically invalidated by the ruling.

Airlangga stated that according to the provisions, the agreement will take effect within 60 days of signing. During that time, each party needs to consult with relevant domestic institutions.

In the United States, the process may involve Congress or the Senate, while in Indonesia, the government will consult with the House of Representatives (DPR).

He also touched on the 10 percent tariff policy previously announced by the US government. According to him, the 10 percent tariff is only valid for 150 days. After that period, the US government can extend or amend the policy in accordance with applicable regulations.

Airlangga stated that the Indonesian government has coordinated with the Office of the United States Trade Representative (USTR). From this communication, it was learned that the US government will make a decision at the cabinet level regarding countries that have signed the agreement.

Indonesia requested that the previously granted 0 percent tariff facility be maintained, despite the existence of a global 10 percent tariff policy for other countries. Several of these 0 percent tariff facilities, including those for agricultural products such as coffee and cocoa, are reportedly regulated in a separate executive order.

In addition to agricultural commodities, the 0 percent tariff facility also applies to the electronics supply chain, crude palm oil (CPO), textiles, and foodware products. The government is still awaiting developments in the 60-day period before the agreement takes effect.

Regarding the quota-based ART scheme, discussions are still ongoing during that period. Currently, according to Airlangga, the US government is still focusing on managing global tariffs across all countries.

He stated that there will be policy differences between countries that have signed the ART and those that have not. For goods from the United States entering Indonesia, previously established tariffs will remain in effect until the agreement is fully implemented. Some commodities, such as meat, have been subject to a 0 percent tariff, while soybeans and several other products are at around 5 percent.

Airlangga also stated that the government has reported this development to President Prabowo. The President has requested that government officials study all possible risks and prepare various scenarios, including anticipating the dynamics of US trade policy.
