TEMPO.CO, Jakarta – An investor in Indonesia's Free Nutritious Meals (MBG) program plans to file a civil lawsuit against the National Nutrition Agency (BGN), seeking the return of Rp218 billion (US$13.4 million) that he says was paid under an agreement that was never fulfilled.
The investor, Mujazin, intends to sue BGN at the South Jakarta District Court, according to his lawyer, Yazdy Alaydrus.
"Yes, we will file a civil lawsuit at the South Jakarta District Court," Yazdy told Tempo by phone on Wednesday, July 8.
Investor Alleges Breach of Contract
Yazdy said the lawsuit is based on an alleged breach of contract, claiming BGN has failed to respond despite repeated efforts to resolve the matter.
According to him, the dispute stems from an agreement under which Mujazin would take over the development and operation of 97 MBG kitchen units, on the condition that he deposit Rp218 billion with BGN to finance the construction of the kitchens and the procurement of equipment.
Yazdy said the full amount was paid to BGN. Tempo has obtained a video showing the handover of the funds at the agency's office, with part of the payment made in cash and the remainder through a check.
Agreement Signed in 2025
Mujazin, acting on behalf of the Kharisma Cendekia Indonesia Foundation, signed a memorandum of understanding with BGN on September 2, 2025, under MoU No. 02/MoU.20/IX/2025.
The agreement was signed by Mujazin and Lodewyk Pusung, who represented BGN at the time.
According to Yazdy, none of the 97 kitchens promised under the agreement have been handed over to his client.
Lodewyk Pusung has since been named a corruption suspect by Indonesia's Attorney General's Office in connection with the MBG program.
Seeks Return of Rp218 Billion
Through the lawsuit, Mujazin will ask the South Jakarta District Court to affirm the validity of the agreement and order BGN to return the Rp218 billion he claims to have paid, along with interest.
"We will ask the court to order BGN to repay and return our client's money," Yazdy said.
