TEMPO.CO, Jakarta - The Central Jakarta District Court has dismissed a lawsuit filed by 55 residents of Kohod Village, Pakuhaji District, Tangerang Regency, Banten, against the sea fence installation in the waters of Tangerang.
According to a spokesperson for the Central Jakarta District Court, Purwanto S. Abdullah, the citizen lawsuit was filed against alleged unlawful conduct during the land acquisition that was intended for the development of the Pantai Indah Kapuk (PIK) 2 area.
Purwanto said, "The court declared the plaintiffs' lawsuit inadmissible (niet ontvankelijke verklaard)," in an official statement on Friday, August 15, 2025. The court also ruled for the plaintiffs to pay court fees amounting to Rp1,012,000. The court also accepted the objections raised by the defendants and the co-defendant.
Meanwhile, the defendants of the sea fence case include the Indonesian president, the minister of home affairs, the Governor of Banten, the Regent of Tangerang, the Sub-district Head of Pakuhaji, and the Head of Kohod Village. The co-defendant is PT Agung Sedayu Group.
"The court ruled the lawsuit did not meet the formal requirements of a citizen lawsuit," Purwanto said, explaining that the defendants were notified about the case on February 27, 2025. But notification was supposed to be made 60 days prior to the submission. The Kohod residents registered the case on February 18, 2025.
"The co-defendant is a private legal entity, whereas a citizen lawsuit can only be filed against state officials," said Purwanto.
He mentioned that the decision was made on August 12, 2025. The presiding judge was Budi Prayitno, with panel members Sunoto and Arlen Veronica.
