TEMPO.CO, Jakarta - Indonesia requires telecommunication operators to protect unused mobile data. The provision is outlined under the Circular Letter issued by the Minister of Communication and Digital (Komdigi) on Friday, August 28, 2026.
The circular was adopted following the Constitutional Court ruling in July that prohibits telecom operators from forfeiting unused internet data. Communi(MK) Decision No. 273/PUU-XXIII/2025 of July 23, 2026. Komdigi Minister Meutya Hafied confirmed that the expired quota remains the customers' right since it has already been paid for.
"The remaining mobile data cannot simply be forfeited, and operators cannot charge additional fees to maintain the remaining quota," she said in a written statement on Saturday, August 29, 2026.
Meutya wants the policy to provide fair benefits to customers for the internet data they have purchased. Operators are required to provide service options that allow customers to determine the mechanism that best suits their needs.
These service options include quota accumulation (rollover), no quota accumulation (non-rollover), active period extension, benefit transfer, compensation, refunds, and other forms of protection that do not disadvantage customers. "Customers have the right to choose the appropriate service," said Meutya.
Furthermore, the regulation also requires operators to provide clear education and information to customers regarding pricing, quota volume, validity period, usage segmentation, fair usage conditions, service expiration, and the treatment of remaining quota.
Information about customers' rights and service options must be presented simply, clearly, and easily understood. Operators are also required to provide an integrated monitoring channel to make it easy for customers to check the usage and remaining quota of their selected services.
Komdigi has given operators until September 28, 2026, to submit reports on their compliance, with subsequent regular reports required once a month.
Meutya said the ministry has been receiving complaints from the public regarding the MK ruling. "Therefore, we have issued this circular to ensure operators comply with Indonesian legal policies," she said.
